When you represent yourself in court during a divorce, you
are termed 'pro se'. This is one way of obtaining a
cheap divorce. You might want to consider pro
se as an option if your marriage was short, you don't have a
lot of shared debt, and you have no children together.
One way of getting a cheap divorce is through an uncontested
divorce (where all issues are settled outside of the courts).
The best way to go about doing this is to buy a do it yourself
kit online. Getting a cheap divorce is not too difficult as
long as you and your spouse can work together. That being said,
this is easier said than done. After all, a divorce is not the
most pleasant time for either person, and sometimes it may be
hard to get along with your spouse during this time.
I must note that representing yourself in court is not the
easiest task, especially during a hard time such as a divorce.
I do recommend that you do try to hire a lawyer to anyone who
can afford one. You will need to be very familiar with your
state divorce laws if you choose to represent yourself.
So where should you file for divorce if you are going to
take the do it yourself approach? You will have to get in
contact with your court clerk's office in order to figure out
what your requirements are. You will have to mail your petition
to the court clerk, and include 2 extra copies of it. One will
be mailed back to you for your records and the other will be
used to notify your spouse that it has been filed. A fee will
be charged to you for this, so call ahead before you file so
you will be aware of how much you will be charged. If you
really need a cheap divorce, and can't afford this fee, you can
try to have it waived by filing an affidavit. A judge will have
to approve this before your fees will be waived.
